These Terms & Conditions govern your use of TandoPay’s website and services. By using this site or our payment services, you agree to comply with and be bound by these terms.

1. Definitions

• "TandoPay" refers to Tando Business Solutions (Pty) Ltd.
• "Merchant" means a business or individual using TandoPay to process payments.
• "Customer" means the end-user making payment through TandoPay’s platform.

2. Service Description

TandoPay provides online payment facilitation, including e-commerce, pay-by-link, and recurring billing services through PayGate’s secure payment infrastructure.

3. Merchant Responsibilities

• Provide accurate business and banking details for settlement.
• Ensure products or services sold are legal under South African law.
• Handle refunds and customer disputes in accordance with your own policies.

4. Payment Security

All transactions are encrypted and processed through PayGate (Pty) Ltd. TandoPay does not store card details or financial information.

5. Prohibited Use

• Use of the platform for illegal or restricted activities (e.g., gambling, weapons, cryptocurrency, adult content).
• Attempting to reverse-engineer or modify the payment gateway.

6. Non-Solicitation

Freelancers or service providers engaged by TandoPay may not solicit or accept work directly from TandoPay’s clients for a period of 12 months following termination of their engagement.

7. Limitation of Liability

TandoPay will not be liable for any loss, interruption, or damage resulting from delays, technical errors, or force majeure events beyond our control.

8. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the Western Cape High Court.
